Be press release

The press release: Be Announces Sale of Intellectual Property and Technology Assets to Palm

There's an interesting section in the press release that I haven't heard anyone mention:

"Be will be retaining certain rights, assets and liabilities in connection with the transaction. The retained rights and assets include Be's cash and cash equivalents, receivables, certain contractual rights, and rights to assert and bring certain claims and causes of action, including under antitrust laws."

Does this mean Be retains the right to be a plaintiff or witness in an antitrust lawsuit, and receive the benefits of winning such a lawsuit, against say... Microsoft?
